These Terms & Conditions (“Terms”) apply to all bookings made with Travel 2U (“Travel 2U”, “The Company”, “we”, “us”, or “our”), including tours operated solely by Travel 2U or in collaboration with third-party suppliers, operators, guides, transport providers, accommodation providers, and activity operators (“Third-Party Suppliers”).
By making a booking with Travel 2U, you (“Traveler”, “Client”, “Guest”, “Tour Member”) confirm that you have read, understood, and accepted these Terms on behalf of yourself and all persons included in your booking.
1. Booking Confirmation
1.1 A booking is confirmed once a deposit or full payment has been received and a Booking Form has been completed.
1.2 All prices are quoted in New Zealand Dollars (NZD) unless otherwise stated.
1.3 Travel 2U reserves the right to decline any booking at its discretion.
1.4 The person making the booking confirms they are authorised to accept these Terms on behalf of all travellers in the booking.
2. Deposits and Payments
2.1 A non-refundable deposit is required to secure your booking.
2.2 Payments must be received by the due date stated on your invoice or itinerary confirmation.
2.3 Failure to make payment by the due date may result in cancellation of your booking without refund of any deposit or further monies paid.
2.4 Certain tours, events, flights, accommodation providers, or specialty activities may require full payment earlier than the payment dates provided and may be subject to separate supplier terms and cancellation policies.
3. Pricing and Inclusions
3.1 Tour prices include only those items specifically listed in the itinerary or booking confirmation.
3.2 Personal expenses including travel insurance, visas, passports, meals not listed, optional activities, minibar charges, tipping, excess luggage, and incidental expenses are not included unless expressly stated.
3.3 Travel 2U reserves the right to amend prices due to currency fluctuations, fuel surcharges, supplier cost increases, government taxes or levies, and errors or omissions.
4. Third-Party Suppliers
4.1 Travel 2U may act as an organiser, booking agent, reseller, or intermediary for services provided by Third-Party Suppliers.
4.2 Services provided by Third-Party Suppliers are subject to the terms and conditions and operational requirements of those suppliers.
4.3 Travel 2U is not responsible for the acts, omissions, errors, delays, cancellations, insolvency, or service failures of Third-Party Suppliers except where liability cannot legally be excluded under New Zealand law.
4.4 Accommodation requests (including bedding configuration, interconnecting rooms, twin/double preferences, accessible rooms, bath/shower preferences or specific views) are subject to availability at the time of booking and cannot be guaranteed.
5. Cancellations by the Traveller
5.1 All cancellations must be made in writing.
5.2 Cancellation fees apply from the date written notice is received by Travel 2U. Deposits are non-refundable from the date they are paid by the Traveler.
From the deposit date until 120 days prior to departure, only the deposit will be forfeited. Within 120 days of departure, 100% of all monies paid will be forfeited.
No refunds will be available after departure for any unused services or any part of the Tour not utilised.
5.3 No refunds will be provided for unused services, late arrivals, early departures, voluntary non-participation, or no-shows.
6. Amendments and Transfers
6.1 Requests to amend bookings are subject to availability and supplier approval.
6.2 Amendment fees may apply in addition to any supplier-imposed charges.
6.3 Travel 2U is not obligated to permit booking transfers to another person but may do so at its discretion.
7. Cancellation or Changes by Travel 2U
7.1 Travel 2U reserves the right to alter itineraries, substitute accommodation or transport, amend schedules, change guides or activities, or cancel tours where reasonably necessary due to operational, safety, supplier, or weather-related reasons.
7.2 Certain tours, packages, or departures are subject to a minimum number of participants. The Company reserves the right to cancel, reschedule, or re-price any departure where minimum passenger numbers are not met.
7.3 Where minimum numbers are not achieved, the Company will notify Customers as soon as reasonably practicable and may offer alternative departures, alternative products of similar value, or a refund of monies paid (less non-refundable third-party costs where applicable).
8. Force Majeure
8.1 Travel 2U shall not be liable for any delay, cancellation, loss, injury, expense, or failure to perform obligations due to events beyond reasonable control, including but not limited to natural disasters, pandemics, war, terrorism, government actions, industrial disputes, or major transport disruptions.
8.2 In such circumstances, the Company may modify itineraries, substitute services, or cancel arrangements. Refunds, where applicable, will be subject to deductions for non-recoverable supplier costs.
9. Travel Insurance
9.1 The tour price does not include travel insurance. Travel 2U requires all Travellers to obtain comprehensive travel insurance cover.
Travel 2U does not provide advice regarding the suitability, inclusions, exclusions, or premiums of insurance policies except where insurance products are offered directly by Travel 2U.
9.2 Travellers acknowledge that failure to obtain adequate insurance is at their own risk.
10. Health, Fitness and Participation
10.1 Travellers are responsible for ensuring they are medically and physically fit for their chosen tour.
10.2 Any medical conditions, mobility limitations, dietary requirements, or special assistance needs must be disclosed at the time of booking.
10.3 Where a single Traveller is willing to share accommodation with another single Traveller, Travel 2U will endeavour to arrange a room share with another Traveller of the same gender.
Travel 2U accepts no responsibility for the suitability or compatibility of Travellers sharing accommodation.
If, at any time during the Tour, a Traveller considers their room-sharing arrangement unsuitable, Travel 2U will, subject to availability and at the Travellers own expense, arrange single accommodation where possible.
11. Traveller Conduct
11.1 Travellers must behave respectfully toward guides, staff, suppliers, local communities, and fellow travellers.
11.2 Travel 2U reserves the right to remove any traveller from a tour without refund where behaviour is abusive, dangerous, disruptive, intoxicated, unlawful, or discriminatory.
12. Responsibility and Liability
12.1 Travellers participate in tours and activities at their own risk to the extent permitted by law.
12.2 Nothing in these Terms excludes rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or other applicable New Zealand consumer legislation.
13. Photography and Marketing
13.1 Travel 2U may take photographs or videos during tours for promotional purposes unless travellers advise otherwise in writing before departure.
14. Privacy
14.1 Personal information supplied to Travel 2U will be handled in accordance with the New Zealand Privacy Act 2020.
15. Passports, Visas and Travel Requirements
15.1 Travellers are responsible for ensuring they hold valid passports, obtain visas, meet vaccination or entry requirements, and comply with customs and immigration laws.
16. Governing Law
16.1 These Terms are governed by the laws of New Zealand.
16.2 Any disputes shall be subject to the exclusive jurisdiction of the New Zealand courts.
17. Acceptance of Terms
17.1 Payment of a deposit or full payment constitutes acceptance of these Terms & Conditions by all Travellers included in the booking.
